DUI

If you have been arrested for Driving Under the Influence you have ten days to preserve your rights and prevent an immediate driver’s license suspension.  After that ten day period you need a qualified attorney to fight for your interests to avoid a permanent conviction on your record.  The law surrounding DUI arrests is complicated and constantly evolving.  Having an attorney that knows these laws and how to navigate the criminal justice process can be the difference between jail time and a clean record.

Regardless of how bad you think the facts of your case are discussing your case with an attorney may shed light on a possible defense, or another means of avoiding a DUI conviction.

Misdemeanor

Misdemeanor offenses are divided into two categories, first and second degree.  First degree misdemeanors are punishable by fine and court costs, to a maximum of 11 months, 29 days in county jail.  Second degree misdemeanors are punishable by up to 60 days in jail and a $500 fine.  Beyond these statutory penalties, many misdemeanor convictions can have other “collateral” penalties, such as a driver’s license suspension.

An attorney experienced with misdemeanor cases can help you not only avoid the direct, but also the “collateral” consequences of a conviction.  Call our office today to discuss the details of your misdemeanor case.

Felonies

Felonies are punishable by a possibility of more than one year in the Florida State prison system. The degree of felony will dictate the maximum possible sentence.  Felonies are also handled in two primary phases, Pre-Filing and Pre-Trial.  Even though you have been arrested on a felony charge, it does not mean the State Attorney’s Office has formally filed your charges, this is the Pre-Filing phase.  This phase is crucial to your interest because it gives your attorney the opportunity to convince the prosecutor to file the case as a lesser charge, or even to not file the case at all.

Once the charges are filed your case enters the Pre-Trial phase.  This is the time where you need an attorney to fight to protect your rights.  A felony conviction can result in the loss of your right to vote, own a gun, and serve on a jury.  Beyond the loss of these rights, a felony conviction can make it difficult to obtain employment.

Before you face the possibility of a potentially severe and long lasting impact on your life, speak with an attorney in our office about your case.
